Purpose of the association:
Sustainable Children Surgery (SCS) is a non-profit association of public utility and service whose mission is to support the strengthening of the pediatric surgical ecosystem in resource-limited countries, through projects and programs that promote a holistic and sustainable approach. The association also provides general and specific expertise to partner countries and entities, notably advocating for the development and anchoring of the discipline of pediatric surgery.

In particular, it is prohibited to:

9. Donations and Financial Contributions
9.1 Donation Platform
The Site allows for online financial donations to be made to SCS and its projects, via the dedicated page:

Donations can be made using the following payment methods:
- Bank card via our secure payment provider Zahls (www.zahls.ch), compliant with PCI-DSS security standards
- BACS bank transfer (Bank Automated Clearing System)
9.2 Allocation of Donations
The amounts paid are allocated to SCS projects and missions, in accordance with its statutory purpose and associative governance. Unless otherwise expressly stated at the time of the donation (donation allocated to a specific project), donations are considered unrestricted donations and may be used for all of the association’s activities.
9.3 Non-refundability
Unless otherwise expressly stated or required by mandatory legal provision, donations made are non-refundable, it being understood that they constitute gifts within the meaning of Swiss civil law.
In the event of a manifest error during the donation process (incorrect amount, involuntary double payment), you can contact us at info@sustainablechildrensurgery.org for a case-by-case adjustment.
9.4 Tax Certificates
Donation certificates, when available and applicable according to Swiss tax law or the law of the donor’s country of residence, are issued based on the information provided by the donor during the donation process.
We recommend that you check with the relevant tax authorities whether donations made to SCS are tax-deductible in your jurisdiction.
9.5 External Payment Providers
Bank card payments are processed by our external provider Zahls, which may be subject to its own terms and conditions and privacy policy.
The e-commerce platform used is WooCommerce, integrated into the Site.
SCS does not store full bank card data; this data is processed directly by the secure payment provider in accordance with current security standards (PCI-DSS).
10. Data Protection
The collection, processing, and storage of your personal data in connection with the use of the Site and its services (contact forms, online donations, newsletter) are governed by our Privacy Policy, which constitutes a separate document and forms an integral part of this Legal Notice.

This Legal Notice is subject to Swiss substantive law, excluding its conflict of law rules and the Vienna Convention on the International Sale of Goods (CISG).
12.2 Jurisdiction
Subject to mandatory provisions of applicable law (notably regarding consumer protection), any dispute, controversy, or claim in connection with the use of the Site, the interpretation, or the execution of this Legal Notice is subject to the exclusive jurisdiction of the ordinary courts of the Canton of Geneva, Switzerland, subject to an appeal to the Swiss Federal Supreme Court.

The failure of SCS to enforce any provision of this Legal Notice at any time or to tolerate a breach of any of these provisions shall not be interpreted as a waiver of the right to enforce said provision at a later date.
